      1. SUBJECT<\/span><\/strong>

        The subject of this contract is the Protection of the Consumer in force in relation to the sale and delivery of the product, which has the qualifications mentioned in the contract and the sales price of which is specified in the contract, with the preliminary information form, which the BUYER has ordered electronically from the SELLER’s website www.kartonkutu.com.tr. It is the determination of the rights and obligations of the parties in accordance with the provisions of the Law on Distance Contracts, the Regulation on Distance Contracts and other relevant legislation.<\/span>
        The BUYER, basic characteristics of the product subject to sale, sales price, payment method, delivery conditions, etc.\u00a0He\/she accepts and declares that he\/she has knowledge of all preliminary information about the product subject to sale and the right of “withdrawal”, confirms this preliminary information electronically and then orders the product in accordance with the provisions of this contract.\u00a0Preliminary information and invoice on the payment page of Kartonkutu site are integral parts of this contract.<\/span><\/p><\/li>

      2. PRODUCT INFORMATION:<\/span>
        <\/strong>

      3. PROVISIONS ON DELIVERY OF THE PRODUCT<\/span>

        4.1.\u00a0The product will be delivered to the person named `{`user-name`}` by the courier company at the address `{`invoice-address`}` requested by the BUYER in the preliminary information form and in this contract.<\/span>
        4.2.\u00a0Delivery costs belong to the BUYER, unless the SELLER specifies otherwise.\u00a0Even if the BUYER is not at the address at the time of delivery, the SELLER will be deemed to have fulfilled its performance fully and completely.\u00a0The SELLER is not responsible for any damage caused by the BUYER’s late delivery of the product and the expenses incurred due to the product waiting in the cargo company and\/or the return of the cargo to the SELLER.<\/span>
        4.3.\u00a0Delivery is made as soon as possible after the ordered product is produced and the product price is transferred to the SELLER’s account.\u00a0The SELLER delivers the paid product within a legal period of 30 (Thirty) days at the latest from the order.\u00a0If the SELLER cannot deliver the product subject to the contract in due time due to extraordinary circumstances such as commercial impossibility, unexpected circumstances, force majeure or weather conditions that prevent transportation, interruption of transportation, the SELLER is obliged to notify the BUYER.\u00a0In this case, the BUYER may use one of the rights to cancel the order, replace the product subject to the contract with its precedent, if any, and\/or postpone the delivery time until the obstacle is removed.<\/span>
        4.4.\u00a0For the delivery of the product subject to the contract, the “Preliminary Information Form” and this Distance Sales Contract must be approved electronically by the BUYER and the price must be paid in the form of payment preferred by the BUYER.\u00a0If, for any reason, the product price is not paid or canceled in the bank records, the SELLER is deemed to be relieved of its obligation to deliver the product.<\/span><\/li>
      4. REPRESENTATIONS AND COMMITMENTS OF THE BUYER<\/span>
        <\/strong>
        5.1.\u00a0The BUYER accepts that the delivery made to the delivery address and to the person present at this address at the time of delivery shall be deemed as the delivery made to the BUYER.<\/span>
        5.2.\u00a0After the delivery of the product to the BUYER, if the relevant bank or financial institution does not pay the product price to the SELLER due to the unfair or unlawful use of the credit card of the BUYER by unauthorized persons, not due to the fault of the BUYER, provided that the BUYER has delivered the product to the BUYER.         5.3.\u00a0Due to the fact that the forward sales are made only with the credit cards of the Banks, the BUYER accepts that he will confirm the relevant interest rates and the information about the default interest separately from the bank, and that the provisions related to interest and default interest will be applied within the scope of the credit card agreement between the Bank and the BUYER, in accordance with the provisions of the legislation in force, declares and undertakes.\u00a0In installment transactions, the relevant provisions of the contract signed between the BUYER and the cardholder bank are valid.\u00a0The credit card payment date is determined by the contract between the bank and the BUYER.\u00a0The BUYER can also track the number of installments and payments from the bank statement sent by the bank.<\/span>
        5.5.\u00a0If the BUYER cancels the order given by credit card by using his right of withdrawal or for any other reason specified in this contract, the BUYER may take 2 to 3 weeks on average for the amount returned to the credit card by the SELLER to be reflected to the BUYER’s account by the bank. The BUYER accepts, declares and undertakes that he\/she cannot hold the SELLER responsible for possible delays, since the reflection of the BUYER’s accounts after the return to the bank is entirely related to the bank transaction process.<\/span><\/li>
      5. STATEMENTS AND COMMITMENTS OF THE SELLER<\/span>
        <\/strong>
        6.1.\u00a0The SELLER is responsible for the delivery of the contracted product in a sound, complete, in accordance with the qualifications specified in the order and with warranty documents and user manuals, if any.<\/span>
        6.2.\u00a0If the product subject to the contract is to be delivered to a person\/organization other than the BUYER, the SELLER cannot be held responsible if the person\/organization to be delivered does not accept the delivery.<\/span>
        6.3.\u00a0The SELLER declares that the BUYER has the right to withdraw from the contract within 14 (fourteen) days from the date of receipt of the product without giving any reason and without paying any penalty (except for the products where the right of withdrawal listed in Article 7 cannot be exercised) and that the BUYER’s withdrawal notification reaches the SELLER or the supplier. accepts and declares that it can return the product within 10 (ten) days from the date of\u00a0The SELLER shall perform the refund process in accordance with the purchasing method of the consumer within 14 (fourteen) days from the date of receipt of the notification regarding the use of the right of withdrawal.\u00a0The delivery cost of the product returned due to the right of withdrawal is borne by the SELLER.<\/span>
        6.4.\u00a0If the SELLER thinks that the performance of the product has become impossible, it shall notify the BUYER before the performance period of the contract expires.\u00a0In this case, the BUYER may use one of the rights to cancel the order, replace the product subject to the contract with its precedent, if any, and\/or postpone the delivery time until the obstacle is removed.\u00a0If the BUYER cancels the order, the price paid will be refunded within 14 (fourteen) days.<\/span><\/li>
      6. RIGHT<\/span>
        <\/strong>
        OF WITHDRAWAL BUYER;\u00a0In the distance contracts regarding the sale of the product, he can use his right to withdraw from the contract without giving any reason and without paying any penalty within 14 (fourteen) days from the date of delivery of the product to himself or the person\/organization at the address indicated.\u00a0The costs arising from the use of the right of withdrawal belong to the SELLER.\u00a0In order to exercise the right of withdrawal, it is sufficient to give the SELLER a written notification within 14 (fourteen) days, but the proof of the use of the right of withdrawal belongs to the BUYER.<\/span>
        The right of withdrawal cannot be exercised in products that are used in violation of the instructions for use, that are produced in accordance with the special requests and demands of the BUYER, or that have been personalized by making changes or additions.<\/span>
        In case of exercising the right of withdrawal;<\/span>
        a) The invoice of the product delivered to the 3rd person or the BUYER, (If the original invoice is not sent, VAT and other legal obligations, if any, cannot be returned to the BUYER. If the invoice of the product to be returned is corporate, it must be sent together with the return invoice issued by the institution. Order returns, whose invoices are issued on behalf of institutions, cannot be completed unless a RETURN INVOICE is issued.)<\/span>
        b) Return form,<\/span>
        c) The products to be returned must be delivered complete with their box, packaging and standard accessories, if any.<\/span>
        The BUYER is obliged to return the product to the SELLER within 10 (ten) days from the use of its right of withdrawal.\u00a0The SELLER will also perform the refund process in accordance with the consumer’s purchasing method within 14 (fourteen) days from the date of receipt of the withdrawal notice.\u00a0The BUYER is obliged to indemnify the SELLER in case of violation of the Law on the Protection of the Consumer and the relevant Regulations.<\/span><\/li>
      7. STATUS OF DEFAULT AND LEGAL CONSEQUENCES In<\/span><\/strong>
        the event that the BUYER defaults on his credit card transactions, the cardholder will pay interest within the framework of the credit card contract signed by the bank with him and be liable to the bank.\u00a0In this case, the relevant bank may take legal action;\u00a0may claim the costs and attorney’s fees to arise from the BUYER and in any case, in the event that the BUYER defaults due to its debt, the BUYER agrees to pay the damage and loss of the SELLER due to the delayed performance of the debt.<\/span><\/li>
      8. AUTHORIZED COURT<\/span><\/strong>
        In disputes that may arise from this contract, the Consumer Arbitration Committees and Consumer Courts in the place where the consumer purchases the goods or services or where the residence is located are authorized up to the value declared by the Ministry of Customs and Trade.<\/span><\/li>
      9. ENFORCEMENT<\/span><\/strong>
        In the event that the payment for the order placed on the Site is realized, the BUYER shall be deemed to have accepted all the terms of this contract.\u00a0The SELLER is obliged to make software arrangements to ensure that the contract in question cannot be placed on the site without obtaining the confirmation that it has been read and accepted by the BUYER.<\/span><\/li><\/ol>

        RETURN AND EXCHANGE<\/span>

        \u2022 The right of withdrawal cannot be exercised in products that are produced in accordance with the special requests and demands of the product buyer or that have been personalized by making changes or additions.<\/span>

        5- www.kartonkutu.com.tr is not responsible for any problems that may arise from the use of passwords.\u00a0The system allows an e-mail address for each member.\u00a0Therefore, more than one membership cannot be opened with the same e-mail.\u00a0In transactions that can be done with membership, the system will ask the user to enter his e-mail address and a password that is unique to him.<\/span>
        6- www.kartonkutu.com.tr may prevent any member from logging into the system or obtaining a new password, even if the user name and password have been entered correctly, without giving any reason.<\/span>
        7- With this agreement, the Member agrees to be contacted by www.kartonkutu.com.tr for the purpose of presenting campaign applications.<\/span>
        8- The Member, while becoming a member of www.kartonkutu.com.tr, is solely responsible for the damages he may suffer due to incomplete and incorrect information, in case of giving wrong information and in case of breach of this contract by the Member, www.kartonkutu.com.tr He agrees that he can unilaterally terminate the membership without the need for any notice or warning.<\/span>
        9- Member, all rights belonging to Kartonkutu and available on www.kartonkutu.com.tr photos, pictures, information, documents, videos, etc.\u00a0agrees and undertakes not to copy or publish the works or any content for commercial or other purposes.<\/span>
